2. Rights of data subjects

You have the right:

  • to request information about your personal data processed by us pursuant to Article 15 GDPR. If we process your data, you may, in particular, request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, in particular in the case of recipients in third countries, the planned storage period or the criteria for determining it, the existence of a right to rectification, erasure, restriction of processing or to object, the existence of a right to lodge a complaint with a supervisory authority, the origin of your data, if not collected by us, as well as the existence of automated decision-making including profiling and, where applicable, meaningful information on the details thereof;
  • pursuant to Article 16 GDPR, to immediately request the rectification of incorrect or incomplete personal data stored by us;
  • pursuant to Article 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary to, in particular, exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • pursuant to Article 18 GDPR, to demand the restriction of processing of your personal data if the accuracy of the data is disputed by you, if the processing is unlawful but you refuse to delete it and we no longer require the data, but you require the data for the assertion, exercise or defence of legal claims, or if you have lodged an objection to processing pursuant to Article 21 GDPR and it has not yet been established whether our legitimate reasons outweigh your interests;
  • pursuant to Article 20 GDPR, to receive your personal data that you have provided us with in a structured, conventional and machine-readable format or to request that it be transferred to another controller, provided that the processing is based on your consent or a contract and that the processing is carried out using automated procedures;
  • pursuant to Article 7(3) GDPR, to withdraw your consent given to us at any time. As a consequence, we may no longer continue the data processing that was based on this consent in the future; and
  • pursuant to Article 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or work or at our company headquarters for this purpose.

3. Right to object

If your personal data is processed on the basis of legitimate interests pursuant to Article 6(1)(1)(e) or (f) GDPR, you have the right, pursuant to Article 21 GDPR, to object to processing of your personal data if there are reasons for doing so arising from your particular situation or if the objection is directed against direct marketing.

In the former case, we will no longer process your data unless we can prove compelling reasons that outweigh your interests, freedoms and rights or unless our processing serves to assert, exercise or defend legal claims.

In the latter case, you have a general right to object, which will be implemented by us without specifying a special situation. If you would like to exercise your right of withdrawal or right to object, an e-mail to info@tecnicuml.com shall suffice.

4. Disclosure of information

Your personal data will not be transferred to third parties for purposes other than those listed below. We only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Article 6(1)(1)(a) GDPR;
  • the disclosure pursuant to Article 6(1)(1)(f) GDPR is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data;
  • in the event that there is a legal obligation to pass on the data pursuant to Article 6(1)(1)(c) GDPR; and
  • this is legally permissible and required under Article 6(1)(1)(b) GDPR for the processing of contractual relationships with you.

In addition, our processors receive your personal data for processing bound by instructions, insofar as this is necessary for the fulfilment of the order. Our processors have no personal rights of use to your data.
 

5. Data security

We use the common SSL (Secure Socket Layer) procedure within the website visit combined with the highest encryption supported by your browser. This is usually a 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol or by the use of https in front of the address of our (sub-)website. We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

6. Third countries

Data will only be transferred by us to third countries in accordance with legal regulations.

The admissibility of data transfer to third countries is governed by Article 44 et seq. GDPR. If we transfer your data to a third country, you will be informed of this in the special data protection information on the respective processing procedure, stating the respective legal regulation.

Specific data protection information for data processing procedures on the website

1. When visiting the website

When you access our website, the browser used on your end device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer;
  • date and time of access;
  • name and URL of the retrieved file;
  • website from which the access takes place (referrer URL);
  • the browser used and, if applicable, your computer operating system and the name of your access provider.


We process the data mentioned above for the following purposes:

  • to ensure a seamless connection to the website;
  • to ensure easy use of our website;
  • to assess system security and stability; and
  • for other administrative purposes.

The legal basis for data processing is Article 6(1)(1)(f) GDPR. Our legitimate interest lies in the operation of our website and the associated representation of our company.

Your data will be deleted as soon as it is no longer required for the purposes stated, no later than after 6 months.

We use the content delivery network of Akamai Technologies GmbH (Parkring 20, 85748 Garching, Germany, hereinafter: Akamai) to improve the security and delivery speed of our website. In this context, Akamai provides us with its network of servers distributed worldwide, which allows content to be delivered to visitors to our website more quickly and securely. To this end, Akamai sets the necessary cookies and gains access to the above-mentioned data.

The legal basis for the processing of your data in connection with the use of the Content Delivery Network is Art. 6 (1) (f) GDPR, as we have a legitimate interest in making our website faster and more secure, thereby improving the user experience.
Personal data may also be transferred to the parent company of Akamai Technologies GmbH, Akamai Technologies, Inc., in the USA. This company is certified under the EU-US Data Privacy Framework and is therefore considered a secure recipient of personal data; the transfer is then permitted under Art. 45 GDPR on the basis of an adequacy decision. In addition, we have also agreed on the EU standard contractual clauses with Akamai.

2. When registering for our newsletter

If you have expressly consented, we will use your email address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an email address. We need this to send you the newsletter. You can voluntarily provide us with additional information when registering for the newsletter. We may then use this information to personalize the newsletter and tailor it to your needs.

We use the double opt-in procedure for registration for our newsletter. This means that after you register, we will send an email to the email address you provided, asking you to confirm that you wish to receive the newsletter. The purpose of this procedure is to verify your registration and, if necessary, to clarify any possible misuse of your personal data. If you do not confirm your registration within one month, your information will be blocked and automatically deleted after one month. 

When you register, we also store your IP address and the time (date and time) of registration in order to be able to trace any possible misuse of the email address entered. You can unsubscribe at any time, for example via a link at the end of each newsletter. Alternatively, you can send your unsubscription request at any time by email to webmaster@schmersal.com.
We store your data until you revoke your consent.

As part of newsletter management, we use the Dynamics 365 Customer Insights service provided by Microsoft Ireland Operations Limited (One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland, hereinafter: Microsoft). We use a form from Dynamics 365 Customer Insights for newsletter registration, which is integrated into our website and automatically connects to Microsoft servers. We also use this tool for the efficient management of interested parties and the sending of newsletters. We do not evaluate opening or clicking behavior. When you register for the newsletter, the tool sets cookies with your consent, which transmit the following information to us in particular:

  • Client ID
  • Geographic location
  • Type of browser
  • Duration of visit
  • Pages accessed

The legal basis for all processing operations in connection with the sending and management of newsletters is your express consent in accordance with Art. 6 (1) (a) GDPR.

3. When making your application

It is particularly important to tec.nicum to ensure the highest possible protection of your personal data. All personal data collected and processed within the framework of an application to KAS is protected against unauthorized access and manipulation by technical and organizational measures.

We require your personal data in the application documents in order to be able to consider you as an applicant in the application process and to verify whether you are eligible to work for our company. If you provide information that goes beyond this required information, you are voluntarily providing us with this information and agree to its processing.

The legal basis for processing is generally Art. 6 (1) (b) GDPR or § 26 (1) BDSG, insofar as the processing of your data is necessary for the decision on the establishment of an employment relationship with you. Otherwise, Art. 6 (1) (a) GDPR is the relevant legal basis if you give us your express consent to process your data. You can withdraw your consent at any time. You can send your withdrawal of consent at any time by email to webmaster@schmersal.com.

After the application process has been completed, we will store your documents for a further 4 months for evidence purposes.

The legal basis for this is Art. 6 (1) (f) GDPR, as we have a legitimate interest in being able to trace and verify the application process if necessary.

In order to conclude a contract, it is necessary for you to provide us with your personal data in the application documents. Otherwise, we cannot consider you in the application process.

We use onlyfy one (by XING), a service provided by New Work SE (Am Strandkai 1, 20457 Hamburg, Germany, hereinafter: onlyfy), to manage applications. For this purpose, we integrate onlyfy plugins into our website, which display all available job vacancies and enable you to search and filter job vacancies. The plugin is only loaded once you have given us your consent. It does not set any cookies or process any personal data beforehand.

Once the plugin is loaded, it sets a cookie and establishes a connection to the onlyfy servers. Your IP address may be processed by onlyfy in the process. No further personal data is collected via the plugin. 
In particular, the plugin is not used to process application data. Applications cannot be submitted via the plugin, but via the external website https://schmersal.onlyfy.jobs/. Information on how your application data is processed on this external website can be found in the privacy policy there at https://schmersal.onlyfy.jobs/policy.
Onlyfy and we act as joint controllers for data processing. We have therefore entered into a joint responsibility agreement with onlyfy, which you can view at https://www.xing.com/terms/onlyfy-one

5. Contact

You can contact us using the contact details provided on the website or via the chat tool. Depending on the communication channel, your contact data (e.g. e-mail address, telephone number, address) will also be transmitted and processed by us. We process this data to respond to your contact requests. Processing is carried out either on the basis of your consent, which you give by contacting us, on the basis of our legitimate interest in communicating with our customers/interested parties or for the initiation or fulfilment of a contract. Legal bases are therefore Article 6(1)(1)(a), (b) or (f) GDPR.

7. Cookies, analysis tools, plug-ins and other third party elements

We use cookies on our website. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar). Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware. Information is stored in the cookie, which is produced in each case in connection with the specifically used end device. This does not mean, however, that we obtain immediate knowledge of your identity.

Analysis tools analyse the user behaviour of website visitors and enable the operator to optimize the website and adapt marketing measures.
Plug-ins and other third party elements are used to integrate content from these providers into a website.

a) Essential first-party cookies
The use of our essential first-party cookies serves, on the one hand, to make the use of our services more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages of our website. These are automatically erased after leaving our site.

In addition, we also use temporary cookies, which are stored on your end device for a certain fixed period of time, to optimize user-friendliness. If you visit our site again to use our services, we will automatically recognize that you have already been with us and which entries and settings you have made so that you do not have to enter them again.

This data will be deleted no later than after 6 months.

We process your data on the basis of our legitimate interest in the external representation of our company via the website you have accessed and to promote user-friendliness. The legal basis for processing is Article 6(1)(1)(f) GDPR.

Most browsers accept these cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears before such a cookie is created. However, completely disabling cookies may result in the website not being displayed correctly or you not being able to use all the features of our website.

b) Third party cookies, analysis tools, plug-ins and other third party elements
The third-party cookies, analysis tools, plug-ins and other third-party elements listed below and used by us are only used with your express consent and therefore on the basis of Article 6(1)(1)(a) GDPR.

You can withdraw your consent at any time with effect for the future.

Failure to give or withdraw consent may result in the website not being displayed correctly or you not being able to use all the functions of the website.

With the third-party cookie analysis tools, plug-ins and other third-party elements that are used, we want to ensure that our website is designed to meet the needs of our customers and is continuously optimized. In addition, we use tracking measures to record the use of our website statistically and to analyse it for the purpose of optimizing our service for you.

Google Maps
This site uses the map service Google Maps via an API. Provider of the map service is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

The integration of this plug-in by us takes place by means of the so-called two-click method to protect visitors to our website in the best possible way. This means that your personal data (in particular your IP address) is not already transmitted to Google when you access the website. In fact, you must first activate the integrated map by clicking it. With this click, you give your consent to the map showing our company location being loaded and, therefore, to data being transferred to Google.

Pursuant to Article 49(1)(a) GDPR, the data will be transferred with your consent to the USA as a third country if you have given us your consent after we have informed you of the possible lack or limitation of legal protection and the lower level of data protection in the USA compared with the EU.

YouTube
We use social plug-ins from YouTube LLC (901 Cherry Avenue, San Bruno, CA 94066, USA) on our website, a subsidiary of Google LLC. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) in order to make our company better known. The plug-ins are marked with a YouTube logo, in the form of a "YouTube camera" or a "Play" button, for example.

The integration of these plug-ins by us takes place by means of the so-called two-click method in order to protect visitors to our website in the best possible way. This means that your personal data (in particular your IP address) is not already transmitted to YouTube when you access the website. In fact, you must first activate the embedded "buttons" and videos by clicking them. With this click you consent to being connected to the YouTube servers.

Through this integration, YouTube receives information that your browser has accessed the corresponding page on our website, even if you do not have a YouTube profile or are not currently logged in to YouTube. This information (including your IP address) is transmitted by your browser directly to a YouTube server in the USA and stored there. If you are logged in to YouTube, YouTube can directly attribute your visit to our website to your YouTube account. When you interact with the plug-ins, for example by clicking the "YouTube" button, this information is also sent directly to a YouTube server and stored there. The information is also published on your YouTube account and displayed to your contacts.

Vimeo
We use plugins from Vimeo.com, Inc. (330 West 34th Street, 10th Floor, New York, NY 10001, USA, hereinafter referred to as “Vimeo”) on our website to promote our company and to embed videos with further information for you on the website.
The plugins are marked with a Vimeo logo.

We integrate these plugins using the so-called two-click method in order to protect visitors to our website as best as possible. This means that your personal data (in particular your IP address) is not transmitted to Vimeo when you visit the website. Instead, you must first activate the integrated videos by clicking on them. By clicking, you give your consent for a connection to be established with the Vimeo servers.

LinkedIn Insight Tag
We use the LinkedIn Insight Tag for this website, a service provided by LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland (hereinafter: “LinkedIn”). LinkedIn acts as a processor in accordance with Art. 28 GDPR.

The LinkedIn Insight Tag creates a unique LinkedIn browser cookie in your browser and enables the collection of the following data for this cookie: metadata such as IP address, timestamp and page events (e.g. page views).

This technology enables us to generate reports on the performance of our advertisements and information on website interaction. For this purpose, the LinkedIn Insight tag is integrated on this website, which establishes a connection to the LinkedIn server. It enables detailed advertising campaign reports and provides valuable information about visitors to our website. Special data protection information for data processing on our social media channels

1. LinkedIn

We use the social media platform LinkedIn from LinkedIn Corp. (2029 Stierlin Court, Mountain View, CA 94043, USA, hereinafter: LinkedIn).

LinkedIn acts as a data processor for us. We have concluded a data processing agreement, which you can view at de.linkedin.com/legal/l/dpa.

When you interact with us on our LinkedIn profile, we process your (user) name, account information, and any other data you provide on your profile or in the course of communication.

We process your data for the purpose of providing information about our activities and communicating with you. We use our LinkedIn profile for external presentation and to provide information about current topics and our activities. It is also possible to contact you via direct messages or public comments on our posts. We have a legitimate interest in processing your data for the purpose of presenting our company to the outside world in accordance with Art. 6 (1) (f) GDPR. We also process your data if you voluntarily contact us via our LinkedIn profile. The legal basis for processing is then Art. 6 (1) (a) GDPR.

We do not share your data obtained from your LinkedIn profile with third parties. Data that you post publicly on our LinkedIn profile is visible to everyone.

Your data is processed on LinkedIn servers in the US. LinkedIn is certified under the EU-US Data Privacy Framework, so the transfer is based on an adequacy decision in accordance with Art. 45 GDPR. In addition, the standard contractual clauses pursuant to Art. 46 GDPR have been agreed upon, which you can view at de.linkedin.com/legal/l/dpa.

Your public posts on our LinkedIn profile will not be deleted. However, you can delete them yourself at any time. We delete comments that violate legal regulations or our guidelines.

We delete your messages to us as soon as the request has been completed.

2. YouTube

We use the YouTube video platform provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter: YouTube).

YouTube acts as a processor for us. We have entered into a data processing agreement with YouTube, which you can view here: www.youtube.com/t/terms_dataprocessing.

When you interact with us on our YouTube profile, we process your (user) name, account information, and any other data you provide on your profile or in the course of communication.

We process your data for the purpose of providing information about our activities and communicating with you. We use our YouTube profile for external presentation and to provide information about current topics and our activities. It is also possible to contact you via direct messages or public comments on our posts. We have a legitimate interest in processing your data for the purpose of presenting our company to the public in accordance with Art. 6 (1) (f) GDPR. We also process your data if you voluntarily contact us via our YouTube profile. The legal basis for this processing is Art. 6 (1) (a) GDPR.

We do not pass on your data that we receive from you via the YouTube profile to third parties. Data that you post publicly on our YouTube profile is visible to everyone.

In principle, personal data may also be processed outside the EU. The data is then transferred to YouTube in the US in accordance with Art. 45 GDPR. The European Commission has issued an adequacy decision for the US. YouTube's parent company, Google LLC, is certified under the EU-US Data Privacy Framework. In addition, we have agreed on standard contractual clauses (https://business.safety.google/adsprocessorterms/sccs) that provide appropriate safeguards within the meaning of Art. 46 GDPR.

Your public posts on our YouTube profile will not be deleted. However, you can delete them yourself at any time. We delete comments that violate legal regulations or our guidelines.

We delete your messages to us as soon as the request has been dealt with.
